The Amended and Restated Declaration of Covenants, Restrictions, and Easements is filed at Dakota Country with your property records and is now in effect.
This is the foundational legal document of the association. It defines and establishes legal authority for our homeowner’s association (HOA),defines the rules for assessments and dues, specifies homeowner property and common ground maintenance, and documents procedures for architectural changes.
Proposed changes to this document received the required approvals from 75% of owners earlier this year.
The Amended and Restated Bylaws are now in effect.
This is the secondary governing document for the association. It establishes voting rights and procedures, defines and outlines the roles and responsibilities of the Board of Directors, and explains authority the Board of Directors has.
Proposed changes also received the appropriate percentage of owner approvals earlier this year.
The new Rules and Regulations will be in effect October 1
This is a new governing document for Walden that provides additional guidance for items that do not belong in the two other documents. Many of the items within this document were rules and procedures from previous documents (e.g., previous Declaration, pool rules).
The Board of Directors has the ability to create this document per The Amended and Restated Declaration item 5.6.
Owners have until September 30th to submit written opposition to any items listed in the Rules and Regulations. If a majority of owners (51+ homes) do not oppose any of the items, all Rules and Regulations will be in effect October 1, 2025.
Association Annual Assessments (i.e., annual dues) will be increasing for the fiscal year starting October 2025 to $550 annually. Payment required for the October 2025 invoice will be $275.
The Amended and Restated Declaration item 6.2 gives the Board of Directors authority to increase the annual assessment (exclusive of any portion attributable to insurance premiums) by up to ten percent (10%) above the assessment amount for the previous year.
Annual assessments have not increased since 2019.
Walden Association annual expenses have exceeded the income from annual assessments since 2022.
This increase will help align Walden's annual income to the rising annual expense of tree removal and pool maintenance.
